Note: This is not the brand of your computer. To find the name click on your "start" button, click on "run". In the box that appears type in msinfo32 and click "OK" and another box will pop up titled "System Information". In the information on the right hand side there will be "System Name" and beside that is the name of your computer such as "JHSMITH" or "JHSMITH 'S computer" if that is what the system was originally named. Please imput that name in the box above.


Computer Use Agreement

Defendant/Juvenile: By checking below, the above named defendant/juvenile indicates he/she understands he/she has the right to refuse consent to the items contained herein and that the defendant/juvenile voluntarily agrees as follows: computer access to the Internet may pose significant risk of re-offense if not properly managed and the undersigned defendant/juvenile specifically agrees to be fully compliant with the following conditions:

1.) You shall not possess or let another individual possess an unauthorized computer in your home. (unauthorized means any computer that is not being actively monitored by the monitoring service)

2.) You are permitted to use computer systems at your place of employment for employment purposes only.

3.) You are permitted to use computer systems at the educational facility where you are enrolled for education-related purposes only.

4.) You must obtain prior written approval from the Supervising Officer/Designee to use an electronic bulletin board system, Internet relay chat channel, DCC chat channel, Instant Messaging (e.g.AIM, Yahoom, MSNchat, MySpace chat etc..), newsgroup, usegroup, Peer to Peer (e.g. Napster, Gnutella, Freenet, Bearshare, etc.), or any site-based email which provides some measure of anonymity. Use of these types of sites, or programs are strictly prohibited with express written consent from the Probation Department or Probation Officer.

5.) You understand and agree that using the computer for any purpose which might further sexual activity is strictly prohibited. Such use includes, but is not limited to, the following: possession of sexually explicit material in any form; sexually related A chat or email exchange; visiting or joining A chat room which contains sexually explicit conversations; visiting/viewing sexually explicit material on web sites; websites that contain nudity or sexually explicit materials; downloading binary files, UUE files, MIME files, AVI files, MPG files, Real Player files, Windows Media Files, digital images in any format, text files, or multi-media material that is sexual in nature; or visiting and/or subscribing to usegroups, newsgroups, or list servers which contain sexual content.

6.) You agree that you shall be prohibited from possessing or viewing certain materials related to, or part of, the grooming cycle for your crime. Such materials include, but are not limited to, the following: Images of your victim, stories or images related to your crime or similar crimes, images which depict individuals similar to your victims (e.g. children), stories written about or for individuals similar to your victim, Materials focused on the culture of your victim (e.g. children's shows or web sites).

7.) You agree that you shall be prohibited from using any form of encryption, cryptography, steganography, compression, password protected files and/or other method that might limit access to or change the appearance of data and/or images without prior written approval from the Supervising Officer/Designee. If, for work purposes, password protection is required on any system or files used by you, that you will provide the password upon request of Supervising Officer/Designee.

8.) You agree that you shall be prohibited from avoiding the creation of, or altering or destroying records of computer use without Supervising Officer/Designee’s approval. This includes, but is not limited to, deleting or removing browser history data regardless of its age, the possession of software or items designed to boot into RAM, kernels, alter or wipe a computer media, defeat forensic software, or block monitoring software. This also includes a prohibition against restoring a computer to a previous state or the reinstallation of operating systems without the consent of the Probation Officer.

9.) You voluntarily consent to unannounced examination by Supervising Officer/Designee of any and all computer(s) and/or electronic devices(s) to which you have access for the limited purpose of detecting content prohibited by this document, conditions of probation, or court order. This consent to examine includes access to all data and/or images stored on hard disks, Zip Disks, floppy diskettes, CD ROMs, optical disks, magnetic tape and/or any other storage media whether installed within a device or removable and separate from the actual computer device.

10.) You will provide the Supervising Officer/Designee with a current list of all equipment used or possessed by you , including back-up systems, and external storage devices and media. You will keep this list current.

11.) You agree to install, or allow to be installed at you own expense, equipment and/or software to monitor or limit computer use; That you have no expectations of privacy regarding computer use or information stored on the computer if monitoring software is installed and understand and agree that information gathered by said monitoring software may be used against you in subsequent court actions regarding your computer use and conditions of probation.

12.) You agree to be fully responsible for all material, data, images and information found on your computer, or any devices subject to monitoring/search at all times.

13.) You specifically agree and voluntarily consent that your computer may be examined and/or searched at any time, announced or unannounced, by Supervising Officer/Designee to verify compliance with these special conditions of supervision. You understand and agree that your computer, related equipment, and storage devices are subject to seizure by Supervising Officer/Designee if, during an announced or unannounced examination of the computer or other media, the Supervising Officer/Designee finds any evidence of computer use prohibited by this document.

14.) You shall not use or own any device which allows internet access other than authorized by the Probation Department and your Probation Officer. This includes but is not limited to, satellite dishes, PDA’s, Electronic Games, Web-Television, Internet appliances, and cellular/digital phones.

15.) You shall not have another individual access the Internet on your behalf to obtain files or information which you are restricted from accessing yourself.

16.) You shall submit any and all computers and/or devices which allows internet access within your residence for monitoring, which are owned or used by you. All of these computers/devices are required to be monitored under the scope of this agreement, and are subject to random searches by the Probations Department, Probation Officer, or his/her Designee.

17.) You are strictly prohibited from purchasing, playing, registering, or participating in any online game without express written consent from the Probation Department, or Probation Officer.

18.) You are responsible for any and all cost incurred for monitoring services. This includes but is not limited to the initial preview of your computer systems, the licensing of software used by the monitoring service, the monthly monitoring fees, taxes, and any fees incurred from doing an onsite examination that is requested by the Probation Department or Probation Officer. These fees are set out in the Fees schedule attached to this agreement.

19.) You agree to pay your monitoring fees which are due on the 25th of the month prior to the period you are being monitored for. You also agree to pay any additional fees such as licensing fees and the initial benchmarking fees prior to monitoring.

Your designated computer will be monitored by REMOTECOM. It is your sole responsibility to notify any user of the conditions of this agreement.

Neither you or any one who uses the designated computer has a reasonable expectation of privacy while using this system.

This includes contacts with lawyers, doctors, business, and clergy members. By using this system you agree to the terms of this agreement.
